Please read these Terms of Use carefully before accessing or using the HKeTaxi Charging application and related services (collectively, the "Service"). By registering for or using the Service, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not access or use the Service.

Terms & Conditions

Service Provider

The HKeTaxi Charging Service is operated and provided by Tiffdesign Limited ("Company", "we", "us" or "our"), a company incorporated under the laws of Hong Kong. Our registered office is located in Hong Kong.

We provide an electronic wallet and payment platform that enables licensed electric taxi drivers and operators to manage charging transactions at designated charging stations across Hong Kong. The Service is made available solely for lawful purposes and in accordance with these Terms of Use and all applicable laws and regulations of Hong Kong.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

To use the Service, you must:

be at least 18 years of age;
hold a valid Hong Kong driving licence authorising the operation of an electric taxi;
provide accurate, current, and complete registration information; and
maintain the security and confidentiality of your account credentials at all times.

We reserve the right to refuse registration or terminate access to the Service at our sole discretion, including where we reasonably suspect that any information provided is inaccurate, fraudulent, or in breach of these Terms of Use.

By downloading, registering for, or using the HKeTaxi Charging application, you also acknowledge and agree to be bound by the terms and conditions of our service providers, including but not limited to the operators of the charging infrastructure and payment processing networks. Your continued use of the Service constitutes your acceptance of any such third-party terms as may be updated from time to time.

Smart Charge

The following terms govern your use of the in-app electronic wallet and Smart Charge integration features of the Service.

1. Acceptance of Terms

By accessing and using the HKeTaxi Charging electronic wallet application, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use this application.

2. Electronic Wallet Service

This application provides an electronic wallet service for electric taxi charging. All transactions must be verified and are subject to applicable laws and regulations. We reserve the right to suspend or terminate the service at any time.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account and are liable for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account.

4. Privacy Policy

Your use of the application is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using this Service, you consent to our data handling practices as described therein.

5. Payments & Billing

All payments are processed securely. You are responsible for ensuring that your electronic wallet holds sufficient funds for charging services. Refunds are subject to our refund policy and applicable regulations. We reserve the right to decline or reverse any transaction that we reasonably believe to be fraudulent, erroneous, or in breach of these Terms of Use.

6. Limitation of Liability

We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the application. Our liability is limited to the maximum extent permitted by law.

Disclaimers

The Service, including all content, software, and functionality, is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

the Service will be uninterrupted, error-free, or free from viruses or other harmful components;
any defects or errors in the Service will be corrected;
the results obtained from use of the Service will be accurate or reliable; or
the Service will be compatible with all devices, operating systems, or network environments.

We are not responsible for any delays, failures, or interruptions in charging services caused by third-party charging station operators, network outages, power supply issues, or other factors beyond our reasonable control.

Data Accuracy

We endeavour to keep all information and data displayed within the Service as current and accurate as reasonably practicable. However, we make no representation or warranty, express or implied, as to the completeness, accuracy, reliability, or timeliness of any such information. You acknowledge that data including but not limited to charging station availability, pricing, and location details may not reflect real-time conditions, and you should not rely solely on the Service for critical decisions. We shall not be liable for any loss or damage arising from your reliance on information that is outdated, incomplete, or inaccurate.

Navigation Service

The Service may include or integrate navigation and mapping features to assist users in locating charging stations. These features are provided for convenience purposes only. You are solely responsible for exercising safe and lawful driving practices at all times. We expressly disclaim all liability for any accident, injury, loss, damage, fine, or penalty of any kind arising from or in connection with your use of any navigation feature within the Service, including any route guidance that may be inaccurate, outdated, or otherwise unsuitable. It is your responsibility to comply with all applicable road traffic laws and regulations of Hong Kong at all times.

Limitation of Damages

To the fullest extent permitted by applicable law, the Company and its directors, officers, employees, agents, affiliates, and service providers shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever, including but not limited to loss of revenue, loss of profit, loss of data, loss of goodwill, or any other tangible or intangible losses, arising out of or in connection with:

your access to, use of, or inability to use the Service;
any transaction conducted through or facilitated by the Service;
any content, information, or data obtained from the Service;
unauthorised access to or alteration of your account or data; or
any other matter relating to the Service.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the Company has been advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Service is to discontinue your use of the Service.

Nothing in these Terms of Use shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

Copyright

All content, materials, software, text, graphics, logos, icons, images, audio clips, and data compilations available through the Service are the property of Tiffdesign Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws of Hong Kong and international conventions.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial use in accordance with these Terms of Use. You must not:

reproduce, distribute, modify, adapt, translate, or create derivative works of any content from the Service without our prior written consent;
use any data mining, robots, scraping, or similar data gathering or extraction methods;
reverse engineer, decompile, or disassemble any software component of the Service; or
remove or alter any copyright, trademark, or other proprietary notices on any content.

Any unauthorised use of the Service or its content may violate copyright laws, trademark laws, privacy and publicity laws, and other applicable regulations and statutes, and could result in criminal or civil penalties.
